Knowledgeable Child Pornography Defense Lawyers Reviewing Digital Evidence in Key Largo, FL

Many of the most serious criminal charges that a person may face involve sex crimes. These offenses can lead to harsh penalties, especially in cases involving accusations of child sex crimes. Some offenses involving the sexual abuse of children may include claims that abuse was documented through photos or videos. These materials are known as child pornography. People who have been accused of possessing child pornography, sharing materials with others, or directly participating in the creation of child sexual abuse material can face severe criminal penalties.

Child pornography charges are often based on digital evidence gathered during an investigation by law enforcement, and a person will need to understand what to do when they are contacted by law enforcement or when their devices have been seized. Reaching out to an attorney as soon as a person learns about an investigation can be crucial. At Keys Criminal Defense, PLLC, our lawyers can provide the legal representation needed in these cases. We can address the accusations against a person, provide guidance on how to address the evidence involved in a case, and take steps to defend against a conviction for a child sex crime.

Terminology Used in Florida: Child Sexual Abuse Material

Law enforcement officials have begun using the term "child sexual abuse material" (CSAM) instead of "child pornography." This change in terminology emphasizes that child pornography documents the sexual abuse of real children. Florida's statutes have been updated to refer to child sexual abuse material, and courts are likely to take a harsh stance against people who have been accused of these offenses.

Types of Materials That May Fall Under the Category of Child Pornography

Under Florida law, the definition of child pornography covers any visual depictions of minors who are engaging in sexual conduct. It may include photographs, films, videotapes, or digital images or videos. CSAM may also include images that appear to depict identifiable minors engaging in sexual conduct, including photos or videos that have been altered or materials that have been generated using computer software or AI. Any materials that depict real children who are engaging in sexual activities, including sexual intercourse, nudity, or other forms of sexual conduct, could lead to criminal charges.

CSAM Possession Charges

A person may face child pornography charges based on accusations that they knowingly or intentionally possessed, accessed, or viewed CSAM. Charges may be based on claims that a person accessed a website containing CSAM, downloaded child pornography to a computer or other device, or obtained physical photographs or videotapes of CSAM.

Florida law treats the possession of each individual image, video, or file as a separate criminal offense. In cases where photos or videos depict more than one child, a separate charge may apply for each child depicted. Possession of child pornography is generally charged as a second-degree felony, and a sentence of up to 15 years may apply for each count of an offense.

CSAM Distribution Charges

A person may face more serious charges if they are accused of distributing child pornography to other people. This offense is known as CSAM promotion, and it may apply if a person has allegedly attempted to sell, transfer, publish, or advertise child pornography. In many cases, these charges will involve accusations that a person uploaded CSAM to a website or file-sharing service, made CSAM available to others through a cloud storage service or other means, transferred CSAM via email or text messages, or otherwise sold or distributed CSAM.

Child pornography distribution, which is also known as promoting a sexual performance by a child, is generally classified as a second-degree felony. As with CSAM possession, a separate count of this offense may apply for each image, video, or file involved in a case. A person who is convicted will be required to serve a mandatory minimum sentence of five years.

CSAM Production Charges

The creation of child pornography is one of the most serious categories of child sex crimes, since people who have allegedly been involved in filming or photographing minors in sexual situations may be accused of directly participating in child sexual abuse. Anyone involved in these activities, including those who are accused of employing children to create child pornography or authorizing the use of children to create sexually explicit materials, may face CSAM production charges

CSAM production is also known as the use of a child in a sexual performance, and it is classified as a first-degree felony. A person who is convicted will be required to serve a mandatory minimum sentence of 15 years. In offenses involving children under the age of 12, an offense will be classified as a life felony, and the mandatory minimum sentence will increase to 25 years.

Defending Clients Against CSAM Charges

One of the most important factors in a child pornography case involves how the evidence against a person was gathered. Our attorneys can review the procedures followed by law enforcement when investigating an alleged offense and performing searches of a person's home and devices. We can determine whether a valid search warrant was obtained before searching a person's property or whether officers went beyond the scope of a search allowed under a warrant. Any evidence that was obtained through an unlawful search can be challenged, and it may be excluded from a criminal case.

We will also review the methods used to recover and analyze digital files. Metadata, timestamps, and the location of files on a device or network can all become central issues in a case. Depending on the analysis of these issues, we may be able to show that a person had no knowledge of the materials, that CSAM was accessed or downloaded by another person, or that malware was responsible for unintentional downloads.
